# Supa SMS Messaging Terms

**Effective date: 11 September 2026.**

## 1. Operator and scope

These terms cover the Supa SMS/MMS programme offered by BuildPass Pty Ltd (ABN 61 652 324 635; ACN 652 324 635) for Australian customers and BuildPass Inc. (EIN 37-2168499) for US customers, consistent with the entity allocation in the [Terms of Service](terms-of-service.md). They supplement those Terms and the [Privacy Policy](privacy-policy.md). Mobile information is also protected by the [SMS Privacy Statement](sms-privacy.md).

These terms concern text messages sent through Supa's programme. Features using internet messaging, such as iMessage, may be subject to separate channel rules. We will not silently treat consent to one channel as permission for marketing on another.

## 2. Messages you may choose to receive

Depending on the features offered and the choice you make, the programme may include:

- **Verification messages:** a one-time code for each sign-in or verification request you initiate.
- **Requested assistant and service messages:** replies to your conversations, task results, reminders you request and account or onboarding updates within the scope explained when you enrol.
- **Optional marketing messages:** product news, offers or tips, only after the separate marketing opt-in required for that programme.

We identify the relevant categories when collecting consent. Providing a phone number, requesting one verification code or agreeing to the general Terms does not by itself subscribe you to marketing or unrelated recurring messages. Messages may be sent using automated technology. Consent to receive marketing texts is not a condition of purchasing goods or services or opening an account.

## 3. Frequency and charges

Verification is ordinarily one message per request. Assistant and service-message frequency varies with the tasks, conversations and notifications you request. Marketing frequency varies and will be described at the point of enrolment. Message and data rates may apply under your carrier plan, including for replies. Any separate Supa service charges are disclosed before purchase.

## 4. Consent and number ownership

You must be the subscriber or authorised user of the number you enrol and have authority to make the relevant choice. Keep the number current and tell us if it is reassigned or you lose access. We keep evidence of the scope, source and time of consent and subsequent preferences.

If you ask the assistant to message someone else through an available feature, you must have the authority and recipient consent required for that communication. A number in your contacts or a business relationship is not, by itself, marketing consent. We may decline requests where authority is unclear or a recipient has opted out. These terms do not establish a general bulk-messaging entitlement.

## 5. Stopping messages and re-enrolment

Reply **STOP** to a reply-capable Supa number to withdraw SMS consent. You may also contact support@getsupa.ai or use an unsubscribe method supplied in the message. We honour other clear requests to stop as required by law. A sender that cannot receive replies must include an accessible alternative unsubscribe method.

We apply the opt-out to Supa programme texts to your number, including marketing and recurring service messages, across our programme's sending numbers and providers. We do not route around it by changing the sender. We may send one non-promotional confirmation of your opt-out, after which messages stop. Suppression will take effect as soon as practicable and within applicable legal deadlines, including the five-working-day Australian commercial-message unsubscribe limit where it applies.

Stopping texts may prevent SMS sign-in codes and requested task notifications from reaching you. Contact support@getsupa.ai for help accessing the service. We do not treat a new conversation, task or sign-in attempt as automatic re-enrolment. Resuming texts requires a fresh affirmative opt-in after the relevant disclosures; re-enrolling for verification or service messages does not separately re-enrol you in marketing.

Opting out of SMS does not cancel a paid subscription, close an account or request deletion. You can make those requests separately. We may retain a minimal suppression record so that the opt-out continues to be respected.

## 6. Help, delivery and safety

Reply **HELP** to a reply-capable Supa number, or contact support@getsupa.ai. For a non-reply-capable sender, use the support method included in the message.

Delivery depends on carriers, networks, devices and providers and is not guaranteed. Carriers are not liable for delayed or undelivered messages, to the extent permitted by applicable law. This does not exclude any non-excludable rights or obligations of Supa.

Do not use Supa texts for emergencies or time-critical safety alerts. Avoid sending passwords, full payment-card details or other sensitive information by SMS. Messages can appear on a lock screen or be seen by anyone with access to your number or device.

## 7. Australian and US provisions

For Australian commercial messages, we comply with applicable Spam Act 2003 (Cth) requirements, including consent, accurate sender identification and a functional unsubscribe facility. Where a branded sender ID requires registration, we use it only after the applicable registration and provider requirements are met.

For US messages, we obtain consent required by the Telephone Consumer Protection Act and applicable federal and state rules, including separate written marketing consent where required. We observe applicable sending-time, do-not-contact, revocation and carrier requirements. We do not rely on a general acceptance of these terms to bypass those requirements.

Mandatory local law takes precedence. The regional governing-law and dispute provisions of the Terms of Service otherwise apply.

## 8. Privacy, changes and contact

Mobile numbers, messaging originator opt-in data and SMS consent information are not sold, rented or shared with third parties or affiliates for their marketing or promotional purposes. They are disclosed only to providers acting on our behalf as necessary to deliver, operate, secure and support messaging, or where required by law. See the SMS Privacy Statement for retention and rights.

We may update these terms with notice of material changes as required. A change to the programme does not expand your existing consent; where a new purpose requires fresh consent, we obtain it first.
